An Allen man who eluded law enforcement for 15 years was arrested last Wednesday in New York.
Brian Charles Sweeney, now 34 years old, was 19 when he was arrested in Allen in 1997 for sexual assault of a child.
Police in Suffolk County, N.Y., on Long Island, arrested Sweeney on March 28 and charged him with assault with intent to cause physical injury to a police officer and resisting arrest.
According to records on file in the Collin County District Clerk's Office, Sweeney was arrested April 3, 1997, for sexual assault of a child under the age of 17.
His bond was originally set at $20,000, but in September 1997, Sweeney petitioned the court to lower his bond to $5,000 so he could afford to bond out of jail to attend a funeral. His request was granted.
He was scheduled to appear in court in Collin County on Sept. 23, 1997, but did not show up. He was first listed as one of Collin County's 10 Most Wanted in 1998.
Robert Clifford, communications director for the Suffolk County District Attorney's Office, said Sweeney will face charges and likely serve time in New York before he is brought to Collin County. He also faces charges of obstructing government administration and false personation from his recent arrest.
"He is being held on the authority of two outstanding Texas warrants," Clifford said, "for sexual assault of a child and for larceny."
Clifford said Sweeney was pulled over around 8:45 p.m. March 28 for a traffic infraction.
"He suddenly fled on foot from a 1999 Jeep," Clifford said. "He ignored numerous verbal commands to stop. When police caught up to him, he refused to put his hands behind his back before being forced to the ground and placed under arrest."
Clifford added, "The assault charge stems from the defendant's striking the police officer's hand while being placed under arrest."
The criminal false personation charge, Clifford explained, came because Sweeney first told officers his name was Bryan Lane and gave his date of birth as 6/14/1980, "when in fact his name is Brian Sweeney, born 03/02/1978."
Sweeney told officers he was born in Dallas, which may be true. At the time of his arrest, his address was 43 Mill Road, Mastic Beach, N.Y. Mastic Beach is a city with a population of about 12,000, and has as its motto, "Long Island's Best Kept Secret."
Now that Sweeney is no longer listed as one of Collin County's 10 Most Wanted, the following 10 make up the list: Noel Hernandez, 33, sexual assault of a child; Richard Davis Callaway, 48, driving while intoxicated, third offense; Pattyann Hutson Kenley, 44, aggravated sexual assault of a child; Phillip J. Kenley, 47, aggravated sexual assault of a child; Otis Romanuel Cooper, 32, attempt to take weapon from an officer; Joe Roland Martinez, 31, manufacture/delivery of a controlled substance; Susan O'Conner, 43, interfering with child custody; Benjamin Garcia Sanchez, 53, indecency with a child; Filiberto Roman Vega, 49, aggravated assault with a weapon; and Hamed Shahnema Tollahi, aka Darius Hamed Shah, 26, manufacture/possession of a controlled substance.
